Castelli Trust Reverses Preliminary Injunction

In Castelli Trust, the Superior Court in an unpublished opinion reversed the Orphans Court’s entry of a preliminary injunction where the

trial court abused its discretion. It acted on its own motion and failed to make findings about any of the six factors required to issue a preliminary injunction. Furthermore, although there was a hearing, the hearing focused on whether Napoli should be removed as trustee, and not on whether the court should grant injunctive relief.
